“LG UNSIGNED” PROMOTION TERMS AND CONDITIONS
Stage 1
Entry is only open to Australian residents aged 18 years or over who are:
- a solo artist or a member of a band with up to five (5) members;
- are available to travel to Sydney, NSW on 01/09/10 (with their band, if they are a member of a band); and
- are able to travel between 23/09/10 and 27/09/10 (with their band, if they are a member of a band) to perform at the F1 Rocks with LG concert at the 2010 Formula 1 SingTel Singapore Grand Prix event (“Eligible Entrant”).
To enter Eligible Entrants must during the Promotional Period:
- visit lgunsigned.com.au, follow the prompts to the competition entry page, complete the requested details including their band or solo artist name, the full names of each member in their band or their full name (if a solo artist), address, email address, mobile number and the number of members in their band (if applicable) (up to 5 members permitted), and tell the Promoter in 100 words or less about their band and why they should perform at the F1 Rocks with LG concert at the 2010 Singapore Grand Prix; and
- upload 1 x original song composed and performed by them or their band in mp3 format (no greater than [10] MB); 1 photo of them or their band (as applicable), in JPEG, GIF or PNG format, and 1 x biography about them or their band (as applicable) in 250 words or less;
and submit the fully completed entry form between 04/08/10 and 11.59pm AEST on 26/08/10 (“Promotional Period”).
Stage 2
A shortlist of semi-finalists will be created by a panel of judges based on creativity, originality and talent of the band/solo artist.
The shortlist of semi finalists will be emailed the following questions (to the email address provided on entry):
- “How many original tracks have you recorded?”
- “How long has your band been together?”
- “How did your band get together?”
- “What’s the biggest audience you’ve played in front of?”
- “What has been your most memorable gig?”
Semi-finalists must also be available to travel to Sydney, NSW on 01/09/10, if selected as a Finalist.
Stage 3
A panel of judges will judge the email responses provided by the Semi-Finalists based on their creativity, originality and overall appeal.
The three (3) best Eligible Entrants (as selected from the list of Semi-Finalists), as determined by the panel of judges, will win the opportunity to perform at The Beach Road Hotel in Bondi, NSW on 01/09/10 (“Finalists”). This performance will be filmed by the Promoter and/or its nominees.
Finalists must also be available for media interviews from 5.00pm on 01/09/10.
*Finalists must provide their own musical instruments, sound mixers and any other equipment required for the performance at the Beach Road Hotel. Any costs associated with transporting their instruments, sound mixers or other equipment that is essential to the performance at the Beach Road Hotel are the responsibility of the Finalists.
If a Finalist resides outside of NSW, return economy flights from their nearest capital city to Sydney, NSW (or from the nearest capital city of the majority of the band members, as determined by the Promoter) and twin shareaccommodation for one (1) night at a 3] star venue will also be included for the solo artist or each member of the band (up to a maximum of 5 people). Any band members or solo artists that reside in NSW will not receive such airfares and accommodation. In the case that flights are provided for a band that has made it as a Finalist, all band members must depart from the same capital city (as specified by the Promoter).
If a Finalist chooses to bring family/friends to their performance or requires any additional people to assist with their performance, they will be responsible for all costs associated with travel of these additional people to and from the performance.
Stage 4
The recording of each Finalist’s performance (from Stage 3) will be uploaded onto the promotional website for judging by the public between 06/09/10 and 11.59pm AEST on 16/09/10.
The Finalist with the most valid votes will receive 30 points. The Finalist with the second most valid votes will receive 20 points. The Finalist with the third most valid votes will receive 10 points. In the event of a tied vote, the points will be split.
A panel of judges will also judge each Finalist based on their performance in Sydney and their interview skills from the interview conducted before the performance, and provide a score for each Finalist (out of 70).
Each Finalist will receive a final score. The final score will be determined by the numbers of votes they receive from the public (30% of their final score) and the panel of judges’ score (70% of their final score).
Stage 5
The Finalist with the highest final score will win the Major Prize including the opportunity to perform at the F1 Rocks with LG concert at the 2010 Formula1 SingTel Singapore Grand Prix. The Promoter will be responsible for transporting or providing all musical equipment associated with the performance in Singapore.
The 2nd and 3rd placed Finalists (i.e. the Finalists with the 2nd and 3rd highest final scores) will each win the Runner-Up Prize.
GENERAL
- Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Each band that enters can only have a maximum of five (5) band members.
- Bands or solo artists that submit an entry into this promotion must not be signed to any recording label, nor have entered into any agreement to licence, assign or otherwise dispose of any rights including without limitation copyright in any sound recording (excluding any copyright collecting society in respect to public performance) in particular any record label or music publisher that may limit rights granted under these Terms and Conditions.
- In the case of an Eligible Entrant that submits an entry on behalf of a band, all band members must have read and agreed to these Terms and Conditions. Failure to do so may deem the entry ineligible, at the Promoter’s discretion.
- Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- The Promoter reserves the right, at any time, to verify the validity of entries, Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and bands and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Incomplete or indecipherable entries will be deemed invalid.
- Only one entry permitted per Eligible Entrant.
- If there is a dispute as to the identity of an Eligible Entrant or band, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant or band.
- Winners will be notified by telephone on Friday, 17th September.
- This is a game of skill and chance plays no part in determining the Finalists.
- The Promoter’s/judge’s decision is final and no correspondence will be entered into.
Major Prize
- The Major Prize consists of:
- a trip for the winning band or solo artist to perform at the F1 Rocks with LG concert at the 2010 Formula1 SingTel Singapore Grand Prix valued at up to $20,000 depending on point of departure; and
- 1 x LG product pack valued at $4,946, consisting of:
- one (1) LG 55” (139cm) Full HD LCD TV with built in HD tuner (model 55LD650) valued at RRP$2,999;
- one (1) LG 1100 Watt Wireless Blu-Ray Home Theatre System (model HB905TAW) valued at RRP$999;
- one (1) LG DVD/CD Microsystem (model FB164DAM), valued at RRP$499; and
- one (1) LG Optimus mobile phone, (model GT540) valued at RRP$449.
If the Major Prize winner is a band, the LG product pack must be shared between all members of the band.
- There will be one Major Prize winner. The prize trip includes return economy airfares for each member of the winning band (up to five (5) people) or the winning solo artist (as applicable), from the Major Prize winner’s nearest capital city to Singapore. If a band is named as the Major Prize winner, with each member of the band living in different capital cities, the whole band must depart from and return to the same Australian capital city, as determined by the Promoter.
The prize trip also includes four (4) nights twin share accommodation at the Intercontinental Singapore, tickets for each band member/solo artist to the 2010 Formula 1 SingTel Singapore Grand Prix, return transfers from the Intercontinental Singapore to the 2010 Formula 1 SingTel Singapore Grand Prix. It also includes meals, insurance and transfers within Singapore. Additional spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
- The Finalist (and all members of the band, if applicable) must provide their contact details and copies of their passports to the Promoter by 01/09/10.
- The Major Prize must be taken to coincide with the 2010 Formula 1 SingTel Singapore Grand Prix event with flights departing on 23/09/10 and is subject to booking and flight availability.
- The Major Prize winning band members/solo artist must ensure that they have valid passport(s) (with a minimum of six (6) months validity), and any requisite visas, vaccinations and travel documentation. Frequent flyer points will not form part of the Major Prize. The Major Prize is subject to the standard terms and conditions of individual prize and service providers.
- The Major Prize winning band/solo artist must agree to record a video diary of their Singapore experience. The video diary becomes the property of the Promoter. The video diary will not be returned to the Major Prize winning band/solo artist. As a condition of entering into this promotion, the Major Prize winner agrees to assign all of their rights, title and interest (including copyright) in and to their video diary to the Promoter. Major Prize winners consent to any use of their video diary which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
- The F1 Rocks with LG concert prize is subject to the event venue terms and conditions. The Promoter and event organizers hereby expressly reserve the right to eject any band/solo artist for any inappropriate behaviour, including but not limited to intoxication, whilst performing/being at the 2010 Formula 1 SingTel Singapore Grand Prix event.
Runner-Up Prize
The Finalists with the second and third highest scores overall will win an LG product pack (“Runner-Up Prize”) consisting of:- one (1) LG 55” (139cm) Full HD LCD TV with built in HD tuner (model 55LD650) valued at RRP$2999;
- one (1) LG 1100 Watt Wireless Blu-Ray Home Theatre System (model HB905TAW), valued at RRP$999;
- one (1) LG DVD/CD Microsystem (model FB164DAM), valued at RRP$499; and
- one (1) LG Optimus mobile phone (model GT540) valued at RRP$449.
The total value of the Runner-Up Prize is $4,946. If Runner-Up Prize winner is a band, the LG product pack must be shared between all members of the band.
- In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
- The mobile phone provided as part of the Major Prize and the Runner Up prize is a handset only. Each mobile phone recipient will be responsible for making all arrangements for connection with a service provider and payment of all associated connection, access and call charges.
- If for any reason a winner does not take an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
- If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
- Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
Eligible Entrants will retain ownership in all lyrics and music subsisting within the tracks that they submit, however (unless otherwise advised), Eligible Entrants license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display the Tracks in conjunction with this Promotion, LG and/or MTV. Eligible Entrants agree not to assert any moral rights in relation to this use by the Promoter and warrant that they have the full authority to grant these rights.
All other material submitted or created by an Eligible Entrant in order to participate in this promotion including comments, recordings and images, and any recording produced during a Finalist’s time in Sydney and the Major Prize winner’s time in Singapore becomes the property of the Promoter.
All material created in relation to this promotion (including material used to submit an entry into this promotion) shall be collectively referred to as “Content”.
Eligible Entrants agree that they are fully responsible for the Content they submit or produce. The Promoter shall not be liable in any way for such Content submitted or produced (to the full extent permitted by law). The Promoter may take down any publicly displayed Content without notice for any reason whatsoever. Eligible Entrants warrant and agree that: (a) their entry is an original work (b) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (c) they will obtain prior consent from any person or property that appears in their Content; (d) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (e) their Content shall not contain viruses or cause injury or harm to any person or entity; and (f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the Eligible Entrant agrees to indemnify the Promoter for any breach of the above terms.
- By entering the promotion, Eligible Entrants consent to the Promoter using their name, their band name or solo artist name (as applicable), likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize values to that stated in these Terms and Conditions; (e) if the 2010 Formula 1 SingTel Singapore Grand Prix event or the Sydney event/performance is cancelled/postponed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or Eligible Entrant; or (g) use or taking of a prize.
- Certain legislation implies warranties or conditions or imposes obligations upon the Promoter which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extend. These Terms and Conditions do not exclude or limit the application of any statutory provision where to do so would contravene that statute or a cause any part of these Terms and Conditions to be void.
- The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. By participating in the promotion, each entrant acknowledges that a further primary purpose for collection of entrants’ personal information is that the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. Eligible Entrants should direct any request to access, update, correct personal information or opt out of receiving further communication to the Promoter. All entries become the property of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
